Review of a trial judge's decision, made pursuant to the standards set forth in Commonwealth v. Lanigan, Mass. In a products liability case brought against the manufacturers of silicone breast implants, the record of a hearing on the defendants' motion to exclude expert testimony offered by the plaintiffs on causation issues relating to alleged injuries arising from silicone breast implants supported the judge's conclusion that the testimony had a scientifically valid basis despite the absence of supporting epidemiological data: the admission in evidence of the testimony was proper.

Reports from thousands of women that breast implants are causing problems like debilitating joint pain and fatigue, claims long dismissed by the medical profession, are receiving new attention from the Food and Drug Administration and researchers. This may be a long-awaited moment of validation for tens of thousands of women who have been brushed off as neurotic, looking to cash in on lawsuits or just victims of chance who coincidentally became ill while having implants. The breast implant scare is simply the most extreme of a number of similar alarms that have swept across the country over the last 20 years. Evaluation of the rupture of silicone breast implants by mammography, ultrasonography and magnetic resonance imaging in asymptomatic patients: correlation with surgical findings. Women who receive silicone gel-filled breast implants do not have a higher risk of breast cancer or other cancers and do not experience lower survival rates after breast cancer diagnosis, according to a new report published in the November issue of Annals of Plastic Surgery. This is the first exhaustive review in almost a decade of the health effects of cosmetic breast implants. The two cancer epidemiologists surveyed the epidemiological evidence on the safety of breast implants, including numerous large cohort studies with long-term follow-up.
SILVER SPRING, Maryland — Members of a Food and Drug Administration advisory committee scrutinizing the safety of breast implants urged the agency on Tuesday to take steps to ensure that patients have a clearer understanding of the risks — which includes a rare cancer that is linked to several deaths around the world — posed by the devices. The members, speaking at the conclusion of a two-day FDA hearing, signaled support for a standardized, easily understood consent form that would lay out the major risks of the devices and be reviewed by patients and their doctors before a woman underwent surgery. They said the FDA could negotiate the format and content of the consent form with patients, plastic surgeons' groups and manufacturers. Frank Lewis, chairman of the agency's panel on general and plastic surgery devices, said the current documents written by manufacturers are too long — some are more than 70 pages — and unwieldy.
